google adwords

Anybody use them?
I notice that when I google a company, I often get a goggle adword hit for their competitors. They must have the competitors name or product on adword linked to their site. Does anyone know what is the legal position is when you use a competitor's product name or trademark like this?
I have a very large US competitor who until now has been the sole producer of a product worldwide but which we soon hope to sell our own version of it in the UK ( cppyright/patent lawyers have cleared us to do that).
Let's say the US product is something simply descriptive of the product but where he has coined the phrase, like 'sonic barrier heating' and his company alone offer these sonic barrier heating products under the name "Sonics US" without any specific product being called 'sonic barrier heating'. He has a trademark on 'Sonics US' but not on sonic barrier heating.
Can I adword 'sonic barrier heating', or even 'Sonics US'?

My former job was in online marketing and I used AdWords.
You can coin any phrase that isnt trademarked to them, however even if it is trademarked you can still use it if they havent contacted google to alert them to this.
Sponsor whatever you want, if theres a problem then google will tell you about it.

Sounds good, almost like hijacking their marketing spend! As there ae only 2 players currently in the market place I guess demand for the descriptive product name won't be high enough to make it too costly. You can coin any phrase that isnt trademarked to them, however even if it is trademarked you can still use it if they havent contacted google to alert them to this.

It's a good tactic to do this.
I used to advertise for a number of clients, whom all had different competitors.
There used to be a few tricks you could use so you could sponsor keywords and it would knock your competitors ad off google, ie you could sponsor their term and theyre ad would never show up untill you were caught.
If you need any other advice feel free to mail me.
