Just looking to seek a bit of advice
Mrs Ted has recently booked a hol to Turkey with First Choice for next year in a nice 5* hotel and paid a £600.00 deposit and the balance to be paid before March next year.
The place looks very nice and it seemed a bargain.
Anyway today she got a letter of confirmation and they have changed the Hotel without telling us to a Scabby 3 starfurious
Question is the one we booked was advertised on there site on the net and we have printed off the details detailing this, so where do we stand and can we make them honour the one that we thought we were getting
Angry Mr Ted

Read the terms and conditions. Does it say that they can change it? Does it say that they can change it to one which is of equivalent quality?

When you signed up you must surely have seen clause 3585,3 relating to them being able to change the hotel.

What? you didn't read the terms and conditions that would have taken a decent lawyer six days to read and understand?

Oh well, you're fooked.

And in the future book all your own flights and hotels, rather than use some pikey holiday outfit.

I think reducing from a 5* to a 3* is not on really, if they don't play ball maybe contact trading standards

Check out the Ts and Cs, but surely if the holiday is cancelled this early, you won't incur penalties if you cancel? Or maybe there'd be an admin fee which you can always ask them nicely to waive, since they're the ones who've changed the hotel...

Or was the hotel suspiciously cheap in the first place? Could be they made a mistake on the website and are just correcting it. In which case, still try for a cancellation and a refund of the admin fees. wink

How can you say that? Have you read it? No.

READ THE CONTRACT. It may well say that they can swap at their discretion.

As Monki said, it's not on if they are 'downgrading' you. I know all these companies carry this right in their contracts but surely not to the point where they can offer you any old place (and 3 star in Turkey!!!) It's like when you pick up a hire car, I have never been offered a class below if the car I booked is not available. So if they change your first choice (sorry) they would have to at least offer the same grade?

P.S I have no law experience what-so-ever!
