If you don't own the copyright, or have the permission of the copyright owner (preferably in writing), then making copies of a substantial portion of the work would be an infringement of thier copyright.
Whether the copyright owner would ever take action depends upon the details - a professional photographer is likely to get upset if you modify an image without permission and then sell copies of your modified version of their image. You need to judge the risk or take more specific advice.
There is no need for an assertion of copyright by the owner - it is an automatic right.
