P2P Downloading Legalities

Regarding P2P downloads...

The point at which the copyright law is broken is the duplication of the original material into a format easily accessed via the internet. (DVD Ripping, CDA to MP3 etc) Therefore the person carrying out the act of copying the material is breaking the law.

So why is downloading this material, once in the public domain deemed illegal?

A real world (as oppsed to cyberspace) scenario is that it maybe akin to 'handling stolen goods'

The letters that the ISP's are sending out infer that it's the sharing of the data that's illegal not the downloading of it. I don't know the technicalities of the law but that's how it looks to me. Obviously p2p doesn't work unless you share out copies of what you download anyway.

Distributing copyright material is illegal in this country no matter how you dress it up.

So why do entities like youtube and metacafe etc. exist quite happily sharing copyrighted material to all and sunder, yet if you download it from a P2P site its seen as illegal? Can you not get software to download youtube videos (fraps??), isn't this effectively the same illegal activity ?
