Employment start date was the 10th Nov 2008 (Monday)

In the contract, two weeks notice until three months after start. Then it moves to one month.

Would I be right in assuming that since no notice was given before 5.30pm (end of working hours according to contract) on Monday 11th Feb 2009, the employee would now be into their one month notice period?

Common sense says yes it should be out of the probationary period, and im pretty sure itd have to be in writing, and they cant fob you off with saying the told you in person etc

Sorry don't know but if it's any consellation, I have just pulled out of my 3 month contract and am expecting to hear the worst next week as a result.

Work pays the bills but your missus keeps the house. Have a holiday and dont worry about it smile

Assuming the change to notice isn't dependant on passing probation (i.e. it changes to one month after 3 months employment no matter what the performance of the employee) then I reckon one months notice kicks in from start of business on the 10th Feb (3 months from 10th Nov is 9th Feb, the 10th Feb would be 3 months and 1 day).
