mad Like banging your head against a f**king brick wall trying to get these refunded. How can anyone justify charging over £50 for going over an account limit by £1. If the money isn't there don't allow the transaction to go in the first place. Of course it wouldn't be in there interests to do this though as they couldn't rip people off by charging these extortiante amounts.

Yep. They've got to get their million pound bonuses from somewhere. Thieving bds! What happened re that test case? Thought things were going to be made easier for us mere mortals to reclaim the money they've been fleecing off us for years?

Been there, still clawing my way back out of the hole!

When your monthly income is the same as your outgoings a few of those charges becomes an overdraft which you can't pay off of and the charges mount and then they lend you money to clear the overdraft etc etc and you are still earning the same as your outgoings but now you have loan repayments you can't afford.

That's ok though, you can have this credit card to help make payments on the loan!

Now you have credit card payments to make and loan payments and you never borrowed any money!!

That's pretty much what happened to me when i was working for st money and i am still paying it back five years later.

The stay on court cases got extended by a further six months in January as did the FSA waiver, so now it'll be reviewed in June 2009. When I am guessing it'll just be extended again. I'm guessing that there are a couple of billion worth of claims on hold at the moment, if the government wanted to do something positive to help in a recession, how about forsing the banks to refund this money to people. Results in more money back into the economy, a slight reduction in househould debt and shedload of positive PR for the governement/banks. Oh, for common sense to make a comeback....

hey, if your with a certain singing yorkshire bank you dont need to be over your limit to get charged.
I got charged each month for a Direct Debit - i was putting the money in around 3-5 days before it was due to go out, yet we'd get a letter saying they'd bounced the DD, so where charging us £40... and because they had actually paid the DD there was no money in the account, so the charge took us over our limit... and therefore got a second charge of £40 for being overdrawn.

First time it happened we thought ok... maybe we made a mistake - second time cash in via cash machine 4 days before... got charged..thought WTF? put cash in 3 days before at quick deposit box that states any deposit before 4pm get credited that day... still charged. put money in at counter 5 days before - again charged..

Each time we'd asked why we'd got charged - given excuses each time. Eventually got fed up and spoke to the manager of the branch who couldnt explain it away 'yes cash machine deposits can take 3 days to clear...' 'well why when we put cash in over the counter 5 days before we still got charged' 'ah... i think theres a problem.'

a few weeks later all charges credited back to the account.

You'd think it would, however the banks are now using this estension of the FSA waiver as an excuse to ignore/decline absolutely all request for them back it seems

As I have said to people before I managed to reclaim over £1000 in bank charges about two years ago by doing it myself.

I would strongly advise anyone to get this money back before new legislation comes into force which I believe is being worked on.

Would love too, they owe me about 4k of illegal charges, But seeing as they don't have to pay their debts they are not bothered.

The sickener is that i am paying them £400 a month so they don't take me to court over the money that i am not allowed to prove that i don't actually owe them.

I love banks.

If you were in the first batch then you're ok. Then they put everything on hold for these court cases.

pretty sure when an account is opened, there are terms and conditions, anyone bother to read them ?

barclaycard tried to charge me for late payment, asked them what did they want, the charge or the card cut up, got it refunded smile

Not anymore it doesn't. Because of the test case and stay on claims banks seem to be using it as an excuse to just completely refuse refunds. Happened to my girlfriend a few months ago. First time it happened on that account, her money went in late, DD for £35 wasn't honoured, they charged her £40. She phoned up, explained the situation, said that £40 charge was more than the actual DD and couldn't see the logic in not allowing her to go overdrawn by £35 but then putting her overdrawn themselves by £40. No result. So she closed the account and went elsewhere.

Hedders, you can't get your own bank charge claim seen due to the stay, so why not let them take you to court over the money they believe you owe them with 'unfair bank charges' as your defense? I bet it's all posturing anyway, I doubt they'd take you to court for this very reason.

What they do is employ debt collection agencies to make your life a total misery frown

I had to with hold payment from the bank and the DCA's for a full year before the debt was frozen. At least i am now paying it back and not just making a contribution towards interest payments.

I don't believe any of us will get our money back from the criminals at the banks. It will be dragged out until the law is changed.

I'm just waiting for some holier-than-thou tt to spark up that "why should you get them refunded? It's in the Ts&Cs and why don't you control your finances better, just like me" rolleyes

I agree the robbing b**tards. I got stung £80 by a Leicester based spainards for being £1 or £3 over my limit. At least nice HSBC allow you to creep over by up to £10 before pulling your pants down.

The problem with this argumument is that they'll screw your credit rating.

What credit rating?? :P

I never want credit again anyway, apart from another mortgage sometime.

Rent is due out on the 25th via standing order
