The US has different levels of murder depending on a number of different circumstances. Chances are there is not enough evidence to charge with first degree (premeditated), but second degree is easier to prove and hence a charge that is more likely to stick.

New York state reserves First Degree Murder for killing a policeman and a couple of others I can't remember.
Effectively second degree murder in new york is like first degree across the rest of the US.

10,000 spoons when all you need is a knife is just stupid. Or bad cutlery planning at best. Unless you find out the next day that a spoon would have done the job just as well and you think "jaysus! I had 10,000 of the feckers!"
