My company has just announced there will be 90 job cuts in our office and a further 90 in their other office. They say the consultation period will be 30 days as less than 100 people will be affected however in total there will be over 100 so surely the 90 day consultation period should apply?

The second issue I have is that within the office, as well as my position being affected also my team leaders and the senior managers will be cut but as there are less team leaders/manager positions available those that are not selected to stay will be considered to be placed within my junior role. To me this sounds unlawful - if a manager's position is made redundant and the role is no longer available can that person then be moved to a junior role when others have been made redundant from this role?

I don't think so.

It does sound unlawful to me but I am no lawyer.

I think the 100 persons rule is per 'location' ..

Twisted - employment isn't my specialism - however, the law talks about a 'place of establishment' and for employment law purposes all businesses would split their various sites into individual 'places of establishment' in order to ameliorate the burden of the longer consultation period.
