I have recently had a print out from the telemetry data in the ecu in my 111R. The details that are pulled out are sobering. There are details of what you would reasonably expect, if the engine has gone above a certain temp, rev peaks (mumble), it lists engine revs between certain ranges and the time spent within those ranges.
The thing that I am very concerned about is speed. Speed is broken down into a number of bands, 1-40 kmh etc. and it lists the amount of time you have spent in each band. Obviously my car has never been above 70mph but if it had at any time in its life it is recorded by those helpful guys at Lotus and is available at any acredited service center. What if these reports made it into a court of law? What if a disgruntled mechanic were to pass on the details to his local copper?, what if you were asked to produce your logs?

Why do Lotus need this info? More importantly how do you stop the telemetary system from recording this data?

I believe that the data protection act should cover you on any of that being released to any 3rd parties without your express written consent.

is the data timestamped? ie. it tells WHEN you were speeding etc or how recently? If not then I don't think it's truly admissable, as you can just explain it away as being done in speed events etc.

If it's not datestamped then were you not in Germany on the Autobahn, or on a trackday?

Another point to consider is that there is no certification of the Lotus ECU as a device approved for speed enforcement purposes by the Home Office, (or the necessary regular calibration that goes with it).

As has already been pointed out, if there is no location data (like GPS) associated with the readings, how can they indicate the road upon which the alleged offence occurred (necessary info for the NIP), or indeed prove that you were on a road at all, and not at a trackday or Autobahn? Furthermore, if there's no timestamp (broken down into proportions of time rather than a log of regularly sampled speed data), how could the rozzers purport to issue a NIP within the required timescale of an alleged offence?

I personally don't think there's any way this data could be used for nefarious speed enforcement purposes, although I have heard unsubstantiated stories of ECU and airbag controller data being downloaded for the purposes of post-crash investigations.

Most modern cars have ecu's which can record this data and have been around for years.

Nothing to worry about as far as the police are concerned.

Morning Guy's

To touch on another point any enforcement agency would need to prove beyond doubt that you were driving the vehicle at the time of the offence, this would also open up a legal minefield, they could not force you into admitting liability as far as I know.

I wouldn't worry about this any way guy's Lotus would not release this information as it would lead to legal action against them.

What? A fat, old, half-drunk bearded guy who exploits disabled people for cheap labour, enslaves wild animals to pull his fat ass all over the place and likes interfering with children in specially built grotto's?

yeah, used to be the case but now you either have to declare or it goes to the registered keeper
