Hid headlight problem failing the MOT.

Can anyone help, my Mini has failed it's MOT on the head lights which seem to level randomly and incorrectly. I have tried a BMW specialist who couldn't help and now I have had to book it in with a dealer at £127 an hour labour to get to the root of the problem. They seem to level differently each time they are turned on. Is there a way to make them stop self levelling so you can use the manual adjust? Any help would be much appreciated.

Just to let people know incase they get a similar problem, it turned out there is a sensor on the suspension incase of a heavy load it adjusts the beam level and this had become stuck so only half an hours labour to fix it so quite reasonable after all!
