Is it cheeky to as for a refund after 7 months?

Have just found a crack in my 2013 Cube Agree GTC Race's seat tube, it looks like it's from the bottom of the seat post flexing against the inside of the seat tube. Have had a few other issues with the bike, the rear wheel was rebuilt twice then warranty replaced over the course of 6 weeks, backwards and forwards to the LBS(who have been excellent). The expander bolt in the head tube was made for a carbon steerer and not an alloy one like the fork has so it kept coming loose which was replaced.
So, would it be cheeky to ask for a refund or different make of bike?

Refund or replacement under warranty I would say was reasonable.

I don't think they have any 2013 frames left and the 2014 frames seat tube looks the same diameter as the previous years model which I'm assuming will still be a weak point.
I've had an Orange frame crack in a similar place which was warrantied, the newer frame had a larger seat tube to prevent it going in the same area.

You've got two options (I believe) firstly to try to return the goods as faulty and ask for a refund, this would be from the LBS and harder I think, although considering the problems you've had it sounds reasonable.

Secondly would be a warranty replacement frame which would come from the manufacturer, which are pretty easy usually.

I don't want to point out the obvious, but have you had enough of the seat post in the seat tube? If not could this have caused the damage?

Either way, I'd still take it back, but focus on the frame problem as that should still be under warranty.

It's cracked half way between the bottle bosses and the top tube and looks like it pivoted at the join of the seat stays/top tube/seat tune joint.
