Lock around my wheel - not mine!

Came out of the gym at half 6 this morning to someone elses lock around my wheel and the rack, in addition to my own. Not alot I could do really, no idea who's the lock was and I was running late for work so I ended up getting a taxi to work.
I realise this could be a scumbags method of ensuring they get access to the bike while I sort this out but its not even a nice bike, its a beater I bought specifically to leave outside like this!
There was a rather nice Giant next to it with no lock, I suspect someone may have had a bit of a senior moment...unless anyone else has any ideas?
I plan on going back later to see if it has been removed!

The thought did cross my mind, take the giant, leave a note explaining with my mobile but I couldnt be absolutely sure and I didnt want to risk being labelled a bike theif since I have a couple of professional registrations to get through in the next few months!

From the Theft Act, 1968...

Basic definition of theft.
(1)A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it; and “thief” and “steal” shall be construed accordingly.
2“Dishonestly”
(1)A person’s appropriation of property belonging to another is not to be regarded as dishonest—
...(b)if he appropriates the property in the belief that he would have the other’s consent if the other knew of the appropriation and the circumstances of it...
6“With the intention of permanently depriving the other of it”.
(1)A person appropriating property belonging to another without meaning the other permanently to lose the thing itself is nevertheless to be regarded as having the intention of permanently depriving the other of it if his intention is to treat the thing as his own to dispose of regardless of the other’s rights; and a borrowing or lending of it may amount to so treating it if, but only if, the borrowing or lending is for a period and in circumstances making it equivalent to an outright taking or disposal.

I'm not sure that the Giant's owner would see it the same way, though

Im afraid its nothing exciting, I went back to the bike in the afternoon and the offending lock had been removed, I can only surmise that it had been put on in error...or a prank, which is unlikely since it was 6AM.
In a more recent development, a return trip to the gym this morning, I found the lock attached around a Raleigh, not Giant. I have an idea of who the lock belongs to now but didnt get chance to ask him.
'Project Crap' as it was termed was actually replaced with a single speed over the weekend. I've gone from n to n+2 in the space of a week

I'd hazard a guess that the Giant has been nicked. 
Ask him so he has the embarassment of telling you how it got nicked
