Pitfalls of trying to use someone else's C2W?

* "Fraud by false representation" is defined by Section 2 of the Act as a case where a person makes "any representation as to fact or law ... express or implied" which they know to be untrue or misleading.
* "Fraud by failing to disclose information" is defined by Section 3 of the Act as a case where a person fails to disclose any information to a third party when they are under a legal duty to disclose such information.

I've seen worse done, lots of C2W bikes being sold prior to the end of the hire agreement some still in the delivery box to make profit.
Needless to say it is treated as theft & gross misconduct, but I'm sure only a small amount actually gets reported.
It will get harder now with new HMRC guidance on final purchase price and needing an agreed valuation to avoid it.
So unless you're 100% sure your friend is not going to be asked why he hasn't brought the company provided bike in to work, and you can present it at the end of the period for valuation or prepared to pay the HRMC amounts on purchasing.
Then i'd steer well clear, just get a 2010 bike after the Christmas rush.
