hi all can anyone tell me if a company doc can overule a gp med 3 sick note, and say the employee is fit
for work and force the employee back to work ?

I think that we need an awful lot more information to help us to come to an informed conclusion.

What is the nature of the illness?

What is the company's sick pay policy?

My gut feel is that the company doctor is more likely to understand the nature of the work, and therefore more likely to be able to assess the patient's ability to carry out the work.

ok he has got low mood and works for the railways driving trains
now he gets full pay for 6 months,his company is sending him for a medical on tuesday

he is having counciling and is on happy pills !
but the rumour is the doc says you are fit to work as long as you have a pulse !

i don't see how the company doctor can over-rule the G.P. maybe i'm missing something. the GP has diagnosed depression and started medication and arranged counselling. now maybe things are improving, but the patient doesn't feel quite ready to go back to *his* job. so he is still on a sick note.

is the company doctor saying he's fit for some kind of work - either going back part time, reduced hours or even with different duties for a while, or is he saying get back to normal job, end of?

he may need to get down to citizen's advice for help with this.

Medical advice is just that, advice; employer has final say in all matters, unless legislation is enacted, such as sectioning under the Mental Health Act. GP has made a diagnosis of medical condition and prescribed. Occupational expert (Company Doc) makes the call to his boss on whether individual is fit to carry out any duties. The collective aim should be to help individual get back to full fitness, and keeping them in safe gainful employment is seen as part of that rehabilitation process. Hope that helps. If still unsure, give HR a call to check company policies in this area.

Even someone with depression can press a button. And then press another one.

Maybe they will get it doing a different job?
Depression is a crap reason for not being at work.

Ive witnessed depression first hand, so Im not belittling it. I know full well how horrible it is.
BUt the fact hundreds of thousands of housewifes manage to run a family with PND (albeit miserably), makes me have little sympathy for people who stay off work with it.
