Help,
I need some urgent advice regards my rights on a work situation that has been presented with.

My employer has given me a choice of two options as they say my position is technically not required at my current location and I have to let them know by 4pm tomorrow (30th Jan) which was 24 hours notice.

The first is that I keep my job title/grade & pay and move to another location that is 20 miles away but I would commute through heavy traffic each morning & evening which would mean that I have to leave home an hour earlier then get home when I get home each night.
At first this does not seem too bad but I will have a significant increase in fuel costs etc, lose of family time & been unable to return home quickly if my elderly relative has an emergency, kids etc.

The second option is that I take a significant (25%) pay cut, a drop in grade/level but stay where I am which they still get my 26 years plus of experience & knowledge for the price of an inexperience person.

The move option wouldn’t be so bad if I got a pay rise/promotion but it isn’t, it is just a move to another location where they have already got two other people doing the same job and more significant members of lower skill level of staff.
I given myself a third option which I stick my heels in and fight/refuse both options, but this could have other knock on effects later if they want to get dirty.
Please help.

Tell them to take a running jump. Twenty four hours notice is very not right - unless you are a probationer stacking shelves at Lidl.

Get the due process sorted and take some time to think it through.

24 hours notice seems somewhat unreasonable for a decision like that.

If that's truly the only notice you have had for a significant change to your terms and conditions, I'd be concerned as it sounds unreasonable. If it sounds unreasonable, then it probably is. Have you sat down and spoken with your superiors about this notice period? What does your contract allow them to do? Do you have a Union rep you could consult for advice? Good luck!

I found this guide booklet earlier and had a quick read, I will have a full read up tomorrow once I have printed it.

I had a 10 minute chat with my line manager & brand manager where I was told of these options.
I cannot find the latest copy of my contract at present (Found the 1985 YTS one though)and the employees hand book which forms part of it does not in form me of a change of contract protocols, & not part of any union.

Sounds v dodgy

Does your workpalce have a Union at all? Something tells me they wouldnt have tried a trick liek that if there was a knowledgable Union prescence.

Well managed to get only 2-3 hours sleep last night & at work the deadline came & went and the subject wasn't mentioned (we were busy)so I hopefully got a couple more days unless the question get asked tommorow?
We do not have any form of union(s)so going have to consult CAB etc for further advice.
In the meantime I am going to ask for the following from my employers which should delay it further,

A complete copy of my employee file which should contain a copy current contract (still cannot find it at home)
Full clearly writen discription of what both option involve and why they have put these option to me & to me only.

It is a little unreasonable, but you might want to keep them onside.

(extra time would probably not change outcome)

Is the 20 mile commute really so bad, and is it worse than the alternative?

ACAS may be able to help with legal questions - http://www.acas.org.uk

Essentially it boils down to whether you wnat to cause a fuss and thereby perhaps burn bridges with your manager. Depends how big the company is - obviously its easier to hide/move away in a larger organisation.

..a lot to be said for better the devil you know..

....maybe revert to existing location at a later date?

A full and frank (but non threatening) conversation is the answer, so both parties can understand the reason why.

At the end of the day you do have a lot of "rights", but once you start to rely on them the relationship may have broken down (and ultimately there's usually only one loser in that scenario)

Where I work is moving location but existing location is being closed, as the distance to travel is an additional 15 miles for me we were given the option of taking redundancy or move with the company. We have been given 4 months notice of this plus various meetings, we have to give our answer after Xmas and even then there are a couple more meetings before its set in stone.

Without knowing the terms of your contract 24hours seems unreasonable. My terms stated my place of work was our current building or within a reasonable distance. Reasonable is down to me not the company but generally accepted as over 10 miles is deemed unreasonable.

I'd seriously suggest getting some professional advice but also speak to your hr dept and find out why you aren't getting a proper notice period and what is in your contract for place of work.

Taking a pay cut may affect your pension rights if based on a final salary scheme. You said you've got 26 years plus experience - if with the same company I'd suggest you opted for redundancy and take the payout.

I should have put this in the original posting but I was pee'd & stressed.
My current place of work is not moving or closing I have been ask to move to the other location, so IF I do move they can employee another person with a lower pay level & thats why they gave me the the options "Move or pay cut"

Jeez, that's a bit cavalier. A few measly grand don't go far these days.

It's what I would do in the same situation. The last company I worked for tricked me into changing work premises by saying I was just supervising there for a short time until a replacement manager could be found. It was further away, parking was difficult and needed a lot of work to get it running correctly. They then shut my shop and said I was the replacement manager. I kicked up a fuss and said I wanted redundancy - they couldn't give it to me as they'd me found an alternative position.

Just to let you know what’s happening,
I asked for a copy of my employee file on Monday last week and we had another meeting this Monday just gone. During this waiting period over the weekend my circumstances’ change regards a family member which forced me on to one option (To stay where I am)
In this second meeting I managed to keep my grade/position & a slightly better deal on the pay cut 16% instead of 25% but back dated to 1st January 2012. It was also found that I have never been issued with a formal written contract (that’s why I could never find it at home) and therefore according to them only the basic notification time given for changes which in my case is none as they informed me of change on the 29th December 2011?
I have yet to receive this updated/new contract to see if anything is wrong with it.
