Employment - T's & C's

Hi all.
I'll keep this brief.
Moved internally within a company that I have nigh on 5 years with now, in October 2011.
Have a basic contract but no T's & C's, i'm in a "new" role but its almost identical to an existing role within the company except for the kit i use, which requires a competancy the existing staff lack. Parts of their local agreement and T's & C's have been applied where it suits management, but now i want payment for overtime, they are saying the rules don't apply.
My query is, as i have been in this role 6 months, and they are yet to negotiate T's & C's, do the existing ones for the shadow job apply, i share the same working hours and conditions, and starting wage, and some of these members of staff have been mentoring me on their kit.
I'm going to have a fight on my hands as my boss is very confrontational, so if there is a precedent for auto-applying t's and c's, that would be useful.
The pre-existing stuff for the other role isnt that fantastic compared to what i used to be on, but its better than nothing. I don't want to involve my trade union or work to rule as that doesnt help anyone, but i'm prepared to resort to it untill this is resolved and a comprimise is reached.
