Should I of been paid my notice period?
Discussion
Hi all just wanted some quick advice about final salary payments when leaving work.
To cut a long story short…
I left my employment last month at which point it was said that I would be on one months notice fully paid which would be taken as ‘garden leave’ (standard accountancy practise thing to do I believe).
This morning one month has passed and I have not been paid, the only reasons I can think this might be are due to:
1. I may owe the employer for fees which they paid for in relation to tuition fees, which are repayable once you have left (could they of deducted these from my final salary??) Or do they have to pay me for my notice period as I was still technically employed during the last month and then invoice me for the o/s fees?
2. Made a clerical cock up (quite likely given there level of competence)
3. God knows what they are playing at!
I’m more concerned as to whether they legally have to pay my notice period even if I was on garden leave.
Many thanks
Probably 2).
The Gardening Leave is making sure you don't steal all your client data while working out your notice. You are still employed by them, and should have been paid as per normal. Give HR a ring. They cannot deduct money from your salary without agreement (though you may have given this as part of your employment contract), and certainly ought not to have done it without informing you.
