Holiday - Company Refusal

Can a company specifiy that you cannot take time off during a certain period of the year?

I have asked my manager for a couple of days of in Dec and he has said no, but nothing has officially been communicated out and we have not been told we are not able to take it?

Did he give a reason? ie, are other staff in your department off or is this a busy period for your company?

We have to take at least 15 days between April and November but this is written into our contract. It is also understood you don't take holiday when others are off within your department if it affects the business.

Busy period but no one else is off that I know off.

Mrs Guinness works in a gym. Her contract states no holiday in Jan, Feb or March. This is because loads of people sign up as new members in the New Year, but the attendance drops off by Easter!

It's written into my contract. Also written is "you may be required to work days/hours as necessary to meet the needs of the business"

I think it all depends on your contract!

Of course, if the OP was a woman wanting several months' maternity leave rather than a man wanting a couple of days off it'd be a whole different story

Yes they can, the employer can refuse a holiday request and they don't need to specify rules in advance.

Maternity leave is not comparable to holiday, and in any event fathers get parental leave too.

'I am giving birth' I have always thought was a reasonable excuse to have time off, regardless of my company's rules about holiday time.

Quite true, because although in both cases the employee is not at work through choice, and the employer has to manage without them whilst continuing to pay out, maternity leave cannot be refused by the employer, whereas holiday can.
