Employer goes pop a week after leaving

I don't know all the details yet but I left my previous employer last week after 11 years service and was owed three weeks wages and 11 days holiday pay which should have been paid at the end of the month via the regular payroll.

I've found out today that a winding up order has been made against the company and that they've shut up shop. A significant number of people have been made redundant and have been told they won't be paid for this month, I guess they may be able to claim statutory redundancy pay but in light of my situation, having left the company, do I have any options to pursue?

You're still a creditor, but I think a bit lower in the pecking order than the redundant people. Count yourself extremely lucky you got out when you did.

My distant cousin was in a similar position. He got paid by the Insolvency Service.

Thinking about it he was actually made redundant. I'm not sure if they are obliged to pay out to ex mployees.

Thanks, from what I know the company is still going to continue in some form and a number of people are staying on (still not being paid for Nov though) so I'm not exactly sure how all this will pan out.

Nope, different sector. I know a little more now, main creditor is HMRC and there is an interested party in the remaining assets.

I've dropped an email to the administrator as a starting point, am I eligible for any form of statutory payment should the kitty be emptied by HMRC?

I thought that if you are owed wages you are a 'preferential' creditor which places you above HMRC in the pecking order. Not sure if this changes due to you leaving though.

HMRC are no longer preferential creditors.

Finally got something through from a company called Insol Employee Solutions today. They know I left a week before the company went pop but have asked me to fill out the standard redundancy application booklet for the Insolvency Service.
