I have a friend who has been I'll and hospitalized twice within the last fifteen months. upon his recent return to work his boss has pretty much told him that there will be consequences work wise if it happens a third time.

now, my friend has several complex issues one of those being depression that has been present for a number of years and has manifested itself in a number of ways . but never in ways that have affected his work and as an employee until these two recent incidents he has rarely if ever been off sick.

I understand that from a contractual perspective he has to maintain a certain level of fitness to undertake his job ( but actually completely irrelevant in his current role). now, my question is,


does him actually getting a clinical diagnosis for depression actually change the way his employer can treat him, so for example if his condition is a byproduct of his depression, can his lack of health be used as a reason to terminate his employment?

what concerns me is that someone who has given years of excellent service, who continues to do excellent service is in effect being told that he can't get I'll again 'or else...' and the reason for his illness is depression.

has anyone ever dealt with this situation and have an understanding what employment law has to say around matters such as this.
