OK really is a friend of mine this one !

Applied for job as teaching assistant in a school CRB check goes off and comes back with a note stating that the person was _'reported'_ as having _'possibly'_ committed a criminal offence 4 years ago.
(reported by a well meaning member of the public who got there facts wrong)

This was fully investigated and they were completely exonerated, no caution, no charge in fact reports on the subsequent investigation proved the opposite of the accusation i.e. they came out smelling of roses!

First time round the head teacher knew and trusted them so was able to ignore the note. Now they want to get into Uni to study teaching and the note added is proving to be a major hurdle.
i.e. the application has stopped pending another investigation of nothing to find!


Does anyone have any advice or experience of similar before we head for a solicitor and pay to find out?

As far as I know, and I'm subject to enhanced CRB checks every year, only actual cautions and convictions show on a CRB check....and only on an enhanced check...unless they're not spent...

I think your friend is being 'economical' with the truth....you can't get 'suspicions' on your CRB sheet...it doesn't detail even if you've been arrested and released w/o charge...

There's more to this story than he's telling...

Wish there was but i have personally seen the check and the note - have also seen the glowing reports from the investigation

So while you should not get suspicions on your crb they have ?

I believe there is a box so to speak that says 'any comments from the Chief Constable' or something. Maybe they put something in there?

Enhanced CRB includes intelligence and suspicions from the police force in question. Finger in the dyke measure to avoid another Wigan, but without actually spending money, with predictable results.

Appalling for the OPs friend.

OK sorry if I'm wrong, it's just that my 'record' is hardly squeaky clean and I've nothing else on their bar my previous convictions and sentencing.....

If there is a note from the CC and it's glowing then I can't see what the problem is, apart from the fact that it shouldn't really be there, if he wasn't convicted of anything....otherwise you're really going into the realms of Big Brother....

Just for my own idle curiosity what was he accused of? Was it something very serious than could be googled? therefore necessitating the glowing note from the CC?

unless the crime he was accused of appears as local intelligence / other information released on behalf of the Chief Constable because the allegation is related to vulnerable people / a hate crime / a Sexual offence .

The alleged crime was drug-ing a child

The said child is disabled and walks a bit funny, the disability is fully documented by doctors, and both school and social workers have put it in official documents that they are exemplar parents.

A judge has also stated that the subsequent investigation was stupid

however the chief constables note remains despite all evidence to the contrary

I believe if it's not a criminal charge you can have it removed. I showed up as being on some "domestic violence register" following a loud barny with a previous girlfriend one night. It doesn't mean I'd hit her, which I hadn't, just that an incident had been reported and if she was found dead in future I'd be someone they would contact.

(I still wait in hope)

File a dispute using the process above as the information is irrelevant, and see it it can be removed.

With that note on unless they can get it shifted they may well be better off not going into teaching, every job application any renewals of CRB and the note pops up, hell the school needing to thin numbers and ...

It would be a brave Senior Officer who removed the file note - would you want to be the next subject of a Sharon Shoesmith style trial by media ? It's also notable that the reason Huntley was able to get appointed to the Caretaker Job at Soham was because Humberside didn't disclose intelligence

Not only is the allegation about a Child, it's about a child that will be seen by the system as particularly vulnerable and involves Drugs - therefore it runs three flags up different flagpoles of concern ...

It's unsurprising that any potential employer or HEI wants to undertake it's own review of the matter before confirming appointment ... the decision to review is probably made by lower to middle manager referring the decision to the head of Dept or Admission tutor ...

In the case of Health, Social Care or Teaching courses the head of dept may have their professional Registration as a practitioner in that field to consider.

The other issue is that while people froth about the perceived injustices of CRB /DBS - often before the issues are resolved, in the next breath they forth about "how could Huntley be appointed to a job at school" and "how do the 'rape gangs' get to wander round with their muslimic ray guns preying on vulnerable teens ?"

Do cautions get 'spent' under the Rehabilitation of Offenders Act 1974? I've seen anywhere from immediately to 3 months.

I picked up a caution (no court, no fine) last year, but on an application I'm filling out it says any that are 'not spent'.

Anyone able to clear this one up for me? Cheers.

mph 1977 resists the temptation to go all out on a LMGTFY rant and just posts the direct link to the MoJ

depending on the exact type of Caution it's either immediate or three months (unless it's an exempt role it's being asked about).

Slightly different but ive just completed the NATO Secret check for my next job. It came back just over a week which apparently is a bit of a record but it had a lot of criminal conviction questions on there which had to be reported back 10 years. I dont know whether CRB is the same but the DBS its all done online and you get a Case Officer assigned to you. He had to speak to me about a date confirmation so if you can, can you try and speak to the Case officer about seeing if its easy to remove and the ramifications?

Sorry, when i said DBS i meant Defence Business Services. They replaced the Defence Vetting Agency
