No P45 from previous job

I left my old job almost two months ago and have not received a P45. To be honest I'm totally clueless about these things and I never even thought about it until I was questioning my pay at my new job and they told me I have an emergency tax code, and advised me to contact HMRC about it. What can/ do I do?

Ask your previous employer to send it.

HMRC will also have the numbers & will (usually) automatically advise your new employer. (eventually)

One of the benefits of RTI.

If you are normal dude tax wise the 1000L wk1 tax code ain't no big deal anyhoo. (And the wk1 will reset in about 7 weeks)

Why wouldn't my previous employer have sent it? Any benefits for them of not doing it? It wasn't a particularly amicable parting so I'm just wondering if there's a motive behind it.

My tax code is '994L week one'. I did have a health plan in a previous job, which I think has affected it.

Perhaps they did & it got lost?

I've just changed jobs and HR told me that I could either send them my P45 or fill out a new form. I think it was called a P46 but don't quote me on it.
Anyway, there is another way! Talk to your current HR.

Where you dont have a P45 tehn you need to complete a P46. Your payroll department should be able to give you one. That will enable your Payroll Dept to put you on a "Week1/Month 1" basis and will mean that you are paying the correct tax based on your current salary. However you may have overpaid/underpaid in total over the financial year depending on your total earnings in your previous job and the total tax that was deducted.

TL;DR

Make sure you have your final payslip from your last job
When you get your P60 from your current job you should be able to use the information on the payslip and the P60 to work out whether you've overpaid or underpaid.

I didn't get payslips from my last job, it was a mickey mouse backstreet repair shop. It wasn't off the books or anything, just extremely poorly run. I have also completed a P46.

So how will you know how much tax you've paid?

It's a legal requirement for your employer to provide you with a payslip.

Lets hope you were on the books, it could get messy otherwise.

AFAIK the P46 will fix your tax code and you'll probably get a rebate for the time you've been on emergency tax for the difference between that and your real tax code.

But a P46 doesn't update your figures, it just assigns the 1000L wk1 tax code which HMRC eventually put right

I'm in the same position and have just filled out a P46 today.

Am I likely to get over-taxed this month, or under-taxed? As I guess its unlikely to be exactly right!

You can't know if you will be overtaxed in your new job without knowing how much salary you had and how much tax you paid in the previous job. That's why the P45 exists.

Employers are extremely naughty if they are not handing P45s to staff as they leave. I would create merry hell with them.

This happened to me last year. I just filled a p46 instead, everything worked out.
