Well, you have three months to bring a claim..

From what you say however it seems unlikely, but you would need to give a lot more information (not wise on a public site of course).

You are way out of time. In any event, it matters not whether or not the management decision was a good one, as employers have the right to make bad business decisions. There can be various procedural and substantive grounds for challenging a redundancy but it is immaterial to discuss them now as you have through delay lost any right to claim that you might once have had.

Why delete the opening question? If anyone is curious, the OP was made redundant last summer. He blamed this on corporate bum licking and the willingness of East Europeans to work for low wages. He said that since then the business has done badly. He wanted to know whether, if the company advertised for someone to do his old job, he could sue.

OP, most redundancies are done on boring bean counting bases, not on the basis of who is the boss's pal. Redundancy is an occupational hazard for almost anyone in employment. Anyway, rather than blaming life's misfortunes on alleged bum lickers, why not push ahead and make yourself indispensable to a future employer?

Redundancy selections come down to one of two reasons, they're expensive or crap.

I have, and I found another job within 6 weeks of being made redundant. As for trying to make yourself indispensible, this has always been my policy, but alas, the bum lickers and empire builders won last time around. The sort of bum lickers who think that a wiring diagram drawn on the back of an envelope is sufficient, and who ship out thousands of pounds worth of 3 phase equipment wired up wrong, yet are still there licking the managements arses.

Apologies for deleting my original post. Every so often I get frustrated at the thought of the bum lickers using systems that I put in place, and the knowledge built up over several years, that is still in my head, yet is now not being used (it was a bit of a niche job, well paid). One thing that I have learnt is that politics will come above any technical ability, and nobody is indespensible.

Anyway, onwards and upwards at the new company wink

Not quite. But perhaps often.

Nope, not always.

Office closures, outsourcing to offshore location, company exiting a line of business, country operations closing down, etc... none fall into your two arbitrary categories.

Can be a massive shock but after the dust settles good time to sit back and decide what do you really want to do
