I wonder if you can help,

I work a 5 day week with every Sunday and Monday off. My Annual leave is 28 days which includes 8 Bank Holidays. (most bank holidays fall on a monday which is my usual rest day)

I am scheduled to be in on Tuesday December 27th which is also a bank holiday. Am I right in thinking that I should get a day in lieu of working that BH?

thanks for your help!

I don't think Tuesday 27th is a bank ( Public Holiday ) holiday.

Public holidays falling on a weekend

Where a public holiday falls on a weekend, you do not have any automatic legal entitlement to have the next working day off work. This will occur in 2016 when Christmas Day (25 December) and New Year's Day (1 January) will fall on a Sunday. This means that Tuesday 27 December 2016 and Monday 2 January 2017 are not public holidays. Your employer can require you to attend work on those days. When this happens you are entitled to one of the following (unless you are a part-time employee – see above):

A paid day off within a month of the public holiday
An additional day of annual leave
An additional day's pay

I don't think so, if your normal holiday includes bank holidays then you already have a day off for it.

so should be getting another day off due to taking the bank holiday on the day it falls a day of leave is a 'working' day not a rest day.

Thanks for your replies, I think my rota has accounted for the bank holidays as I appear to have the correct number of days off!
