Can someone clarify this for me, please? My Mrs works for HMRC and the mat leave states that:

If at 15 weeks before your EWC (We presume this means expected week of childbirth but don't have clarification) you have been in continuous paid service of at least 52 weeks (and you are being paid at the start of your maternity leave)

then

you may take up to 26 weeks contractual paid maternity leave.


Does this mean she needs to have been there 52 weeks 15 weeks before the baby is due, meaning she needs to have been there a year when she is 25 weeks pregnant?

I was confident that was the case but the wife isn't convinced and doesn't want to check with work for obvious reasons.

No - she needs one years continuous service prior to the last fifteen weeks before her expected date

It is 52 weeks, minus 25. (Assuming a 40 wk pregnacy)

So - start on the 1st January, then the earliest you would qualify for the full maternity cover would be if you BECAME pregnant after 27 weeks at the firm. So early August or thereabouts

Or if you prefer, she falls pregnant at 27 weeks of employment. Then has 25 weeks of pregnancy to get to 52 weeks with 15 remaining before EWC

I've deleted my earlier reply as I wanted to clarify;

Simply take the EWC, count back 15 weeks and whatever that date is, in order for her to get contractual maternity pay she needs to be employed at least 1 year prior to that. For example if today was her 15th week prior to the expected week of childbirth, she would have had to of been employed continuously from at least 27th March 2017 in order to qualify for contractual maternity pay.

That's what I thought, so the very earliest she would qualify is, if she falls pregnant after being at the company 27 weeks. That's what we were hoping she's been there 8 months now and isn't pregnant so if she was to fall pregnant tomorrow she would be entitled to full mat leave.

Makes sense so effectively she would have been entitled to full pay after working at the company 27 weeks without falling pregnant before that date.

i do love this phrase though "... to fall pregnant ..."

I use 'smashed to within an inch of her life pregnant' but people think I'm strange, so maybe 'fell pregnant' is a better choice.
