Job quandaries.

A bit of an odd one perhaps, I'm not sure.

I've been offered another job which I've accepted, more money closer to home etc..
All great so far.
Since starting at my old job in January I've never liked it, it wasn't as it was advertised to me as. Part of the job requires clearance, and I was told by the recruiter, and the bigger boss it's a weeks notice until I pass the required clearance.
I've handed my notice in today saying I'm off Friday, to be told there is no probation period and I'm meant to work until the end of the month.
I'm a bit sceptical about this.


New job is keen for me to start Tuesday as it falls in line with quite a few things their end.

Have i dropped a bk? Or do I just go Friday is my last day end of discussion?
I'm not interested in references and I haven't even put current workplace on my cv.

New? Or old?

Old doesn't mention anything about notice whilst in probation. It also doesn't mention anything about clearance.
New want me to start Tuesday.

So you have it in writing that until you get clearance it's a weeks notice, and once you have it then it's a month.

So. Do you have clearance yet?

Do you have a written contract which tells you what your notice period is?

If yes, then that is your notice period.

If no, then your notice period for an employment length of 1 month - 2 years, is 1 week.

My contract states 4 weeks after probation, with no mention as to what it is during probation.
It was all verbal, referring to 1 week. It was my managers boss and the (internal) recruitment agent who told me it was 1 week.

Looks like your contract is a bit vague and you have also been given verbal advice by your employer that you are on probation and are on a week notice. Are you sure you have not received information that you are/are not on probation?

Just tell them you are leaving after the week. I never like to burn bridges with anybody, so be as polite as possible and just say you were advised when you started that it was a week notice on probation, so that is what you are giving. Be polite to everybody.

If they push it, just don't turn up after a week.

One week is the statutory period if for your period of service if no other period is specified in your contract.

Since it appears to have not been explicitly stated, the default position would be usual practice, one week. Also since this is their contract, any ambiguity or miss-interpretation should favour you, as the non-drafting party.

The first I heard of no probation (at all) was after I handed my notice in.
My contract does state that it is 4 weeks notice, with no specific mention of probation.
However, the person who interviewed me and the internal recruiter I went through both said it's a week until I get clearance, which I do not currently have.
So, other than repeating and saying it's what I was told, I'm sticking to it. Anything else I can do?
