Working from home due to injury
Discussion
Hi Guys,
Posted this in health by mistake:
I've got a colleague who has been working from home for 5 weeks due to injury. The job (as mine) is office based, so he is fully capable of working. He couldn't give notice of the time off due to the way things unfolded and has still been able to deliver tasks and has the same workload (granted, he may miss an hour at work to tend to his injury or go to the doctors), and has worked overtime to compensate (not formal paid overtime, just working past 6pm). Friend has medical letters etc so is not pulling a fast one.
My employer seems quite flexible with this but I am wondering, can an employer sack or discipline an employee for this? Could it make said employee more favorable to be "managed out"? I have been in the same position myself with injuries that warrant working from home.
Also, in the case of chronic health issues and interviewing for a new job, where you know from time to time you may be off sick, what's the best way to handle this?
Moving companies is on my roadmap, but not in the immediate future. For me, I wonder if this is something that means I stay where I am in a position with less prospects.
Thanks!

In a word, no. Caveat being that the employee has received medical instruction to work from home and that they continue to fulfil the obligations of their contract of employment. If the matter continues then the company has the right to arrange and independent medical review. As for going for new jobs, I believe you are obliged to inform the employer of pre-existing health issues.
