Hi All

I have recently accepted a job subject to the salary being reviewed every 6 months and increased if I meet the necessary objectives. This was agreed via email, however the contract (not signed yet) does not refer to this, it just states your starting salary is X p.a. and you will be paid in 12 equal installments.

The notice period is 3 months and I may be required to pay training fees if I leave in the first 2 years

I have explained I need to get my salary up to a certain level and if it does not increase as planned I will not be able to remain in the job and will have to return to my other specialism which is higher paid. I am concerned if the 6 month reviews, increments and objectives are not referred to in the contract there is the potential I could end up receiving a salary that does not meet my needs and I will be stuck for 3 months

Please can you advise on whether

I should ask for the salary reviews and details of the incremental increases to be put in the contract

Should I also ask for the objectives to be detailed in the contract?

Are you clear about the size of the increments that are needed?

You could ask for a contractual probation of 12 months, with agreed increments at 6 and 12 months if you hit your objectives. During the probationary period the 3 months notice would be reduced to 1 month.

You want it all expressly stated in the contract i..e if at X date Y target is met (along with setting out the criteria for confirming how the target is met) then the salary increases to Z amount. And so on.

Just have sentence that says "Salary is in accordance with Schedule 1 below" then set out in the Schedule what you require. Something like that.

Oh, and get it reviewed by a lawyer before you sign.

Criteria might be tough before you have started - until you are in the business you won't be able to see how good/bad they really are, and if the targets are achievable?

Alternatively you could have a simple statement that targets and criteria will be set within 4 weeks of employment by mutual agreement?

Good options, thank you.
I have been advised using comparators I may be able to achieve a increase of £7000, so need to think what objectives to break this down to

Also, who determines the training fees?

Your selection of provider, or theirs? You don't want to get hampered by heavy fees. One alternative is to either have it struck, or have the fees pro-rata over the 24 months, so that any liability is 23/24 if you leave in month 2, but only 1/24 by the end of two years.
