Hi All,

I was placed "at risk" in my company had to go through internal interviews, one for my current role.

I did not get any roles - one I applied for I missed out on due to favouritism I am told, and the other I just did not perform as well in the interview.

My boss extended an olive branch to take the same role I am doing but with a grade cut so I took it on.

I am assuming that if I rejected this I could take the redundancy package?

So anyway I took the role and now have a job offer externally, which I am accepting.

This is a week out of my one month trial period so could I still claim redundancy on any grounds? There's been no formal confirmation about my probation.
If not, what if my probation was extended? (This was mentioned when I took the new role if boss agreed, but thre was no reason to).

MrsC did something like this some years ago, a move not a downgrade, but she had a written agreement that she could invoke the redundancy package any time in the following 6 months, and ultimately she did.

it doesn't sound like you have a written or even verbal agreement that you could return to the redundancy option? If not then I would have thought you'd waived your rights to that when accepting the "new' job?

We had something similar about 5 years ago when we had a massive restructure. However it was agreed that the offer was quite generous so I'm fairly sure that isn't a "standard" thing.

Have a word with your HR people.

So you agreed to take the role, continued to interview and now you are leaving and you’d like your bag of money too.

Awesome.

If you didn’t like the role that was the time to accept the offer, before you accepted it.

I have managed redundancy processes they vary massively from company to company, In my opinion and thinking of cases I have dealt with personally you would not then qualify for the redundancy terms unless in the role you are now in you were made redundant, not resign.

Can you go back and re negotiate, they made be glad to be rid of you, so perhaps. I don’t think you will know until you speak to them.

Don’t resign, tell them you don’t think this is working out and that you hadn’t realized how de motivated you would be by the changes etc ... see if they offer first.

You have 6 months to still take redundancy is my understanding.

If they have been generous enough to offer a redundancy I would grab it. If it were my client I would be advising them to simply terminate you and save the cash.
