So looking at my contract, it states that probation period is 1 week notice, once passed it changes to
not less : 3 months notice or increases to 5 weeks after the 5th year.

I'm not trying to circumvent my notice period but to me it could be ambiguous as could be read that after three years it drops to 5 weeks or could it be argued that the or increases to 5 weeks would mean this is effectively tagged onto the 1 week notice period ?

Nope.. it states 3 months, they did make a mistake with the initial contract by putting someone else's name on it (more senior person) and then re-sent it. I suspect that it should be a month but was overlooked

Why start in weeks move to months then back to weeks though? Strange but surely it is there in B&W, 5 weeks notice?

it gets better.. looking at the employee handbook again, which has been signed, it states that everyone is an employee at will with no notice requirements. I know that employee at will holds no value in the UK, but could that override the contractual terms ?
(I know I should have picked this up 8 months ago when agreeing to the contract)

I suspect the issue here is they edited the more senior contract but didn't correct the notice, I strongly suspect it should be 1 month and increase by 1 week after 3 years, the employee handbook wont override your contract....

Thats what I was thinking as well, so I'd assume that I get three months notice and then at year five I revert to five weeks.. strange.

One other question is, can the employee handbook over ride this with the employee at will statement ?
