Is my friend breaking the law?

A friend I work with does the same job as me but does a duty of 12 hours in the day (0500-1700).

This involves 9 hours of driving time, the rest is out the van collecting waste and dropping off unused tubs for waste, or at the yard afterwards emptying the van and restocking the van with tubs.

Van is 3.5t vehicle.

I've looked at the domestic drivers rules and I can see the daily duty is max 11 hours.

Is he breaking the law, or am I being thick /missing something?

In my previous job as a bus driver (domestic rules) I'm sure the max duty time was 16 hours, and 10 hours driving, so I'm struggling to see why driving a smaller vehicle would be different.

Any help appreciated.

Vans don't generally come under any driving rules and regulations so I think he's fine. It only gets complicated if the van driver also drives vehicles over 3.5t and uses a tachograph that driving hours limits come into play.

Sorry not correct. Vans will usually come under domestic regulations (there are exemtions to this). As previously said, if they do more than 4 hours of driving, it limits them to 11 hours of duty time. Duty time however is 'Work. So they may be at work for 12 hours, but they will probably have had some breaks which will reduce 'Duty time, hopefully an hour! A minimum of 45mins is required under working time regulations anyway.
