Hello all. Going to keep it short and simple.

I have been working at this company now for 7 months ( high end landscape gardening). Everything was going well and me nor the boss had any complaints, ( worked with him the last day I Was there and got a load of planting done and he was more than happy ). The next day or the day after I can’t remember I receive a NHS shielding letter stating I should not work or leave the house ect. I go to work the following morning with this letter and pass it to him and suggest I work with the same person for the time being to minimise the “risk”, he told me to work with him that day and will consult with office ( wife I believe ). So that day after work he tells be to take everything from the van I need as I might not be back until lockdown has ended, I did not need anything and left commenting I really don’t mind coming in if it’s just “guidelines”. The next day or two I receive a message saying you are being furloughed from said date until the 2nd of December. Nothing I can do about it but would rather be at work earning %100 than %80 but that’s life. To expecting to return to work on the 3rd of December I receive a WhatsApp message ffs, from the boss QUOTE:

Hi Sean hope you are well unfortunately I have lost a number of jobs since you been off as we couldn’t keep up I am sorry but I have no alternative but to make you redundant the office will be sending you a letter to confirm this and sort out any pay owed to you thanks for your help over the last few months and hope you can sort out some other employment cheers Ian

So ok st happens, but a month before Christmas .. come on... I get paid monthly.

I have not told my wife as of yet and unfortunately I am one of the less “well off” people on this forum. My question is, is this legal and if not where can I go from here? I’m sure people was meant to receive redundancy notice pay ?... basically I know nothing to any help would be appreciated.

Sorry to hear that and I expect this will get moved when it's spotted but you probably want to ask in either the Speed, Plod & the Law or Jobs & Employment Matters forum.

I know nothing but this doesn't seem correct. Sorry that you're in this situation.

P.S. People are going to ask you what your contract says, what your agreement was in terms of notice periods, probation periods etc. I'm guessing your arrangement was less formal than all this but presumably the employer still has obligations.

You’ve worked for them for 7 months , he’ll have to pay you your notice period but no redundancy I’d think.

What kind of boss is he..being made redundant by text? I think you should count it as a blessing and lucky escape. Best of luck finding a new role

Do you not have to be employed for 2 years to receive redundancy payment, rotten situation but if there's no work what can he do.

You are not entitled to redundancy pay based on your time in the role. You will be entitled to be paid for the notice period outlined in your contract as pay in lieu of notice.

You aren't really being made redundant, you're just being let go. Sadly because you haven't worked there for two years, he doesn't need a reason. He will have to pay you any notice period in your contract but nothing else. You should investigate claiming universal credit until you can find further gainful employment.

It is tough Sean, but in the first couple of years a "sorry it hasn't worked out" reason is all that's required. As said, you should expect to get paid for outstanding wages, any notice that you are entitled to & any untaken holiday pay.

I’m not bothered about redundancy pay, I’m not entitled to it but was aware I’d have redundancy pay I.E need to tell you a certain amount of time before making you redundant?.. no contract was shown or offered after repeated attempts to acquire one.

7 months? You have no rights, really. I'm surprised he used the word redundant. I'd have just said "I can't afford to keep you on, so I'm terminating your employment".

You only qualify for statutory redundancy pay if you’ve worked for your employer for at least 2 years.

That's poor that you have no contract. You can be finished immediately but should expect a minimum of a week's notice pay.

Thank you all.. I knew I wasn’t entitled to redundancy, been in a few big companies ect. It just seems st and was wondering what I was entitled to legally as he is the sort off boss who misses payments and if he can he will avoid paying out ect... ( he made one of the lads grab an umbrella leaning on a telegraph pole so he could have it ffs ) 😂

When ‘letting you go’ he cannot discriminate. Are your health conditions classed as a disability?
Does he have other staff?
How did he select you to let go over the other staff?
