Just a broad question really

My girlfriend works part time at a company and has worked there for 18 years most full time and the past 5 years part time since having a child together.

Now she is currently on 80% furlough and is worried about her job (a few long term employees have been made redundant)

A job came up at a local asda for online shopping picker. And they have asked her to go for a briefing and see if she can fit anything in

No she is worried about a few things, one, if she has to tell her current employer, it’s a small business but the owner is quite vindictive and she thinks if he found out, he could just say on your bike.

Also if she didn’t say anything how would the tax work, she doesn’t earn enough for tax atm but a second job could put her into this, would her employer find out then?

Any help is appreciated!

First of all what does her existing contract of employment say?

Only that she can’t work for a competitor, nothing in there about getting another job.

Is that under non-compete (post termination restrictions)?

Is there a clause that she will devote her full time and attention to X company?

Just checked now and it only has a trade secret part not to disclose info to anyone, and one section on unsatisafactory conduct which say she must devote her whole time and attention to work during her normal working hours.

I can’t see anything saying she can’t find another job outside of her hours

There you go then..

You could of course quickly email HR and ask them to confirm that as a part time worker she is free to undertake other work during her days off....

o she could just get on with her life if there's nothing in her contract to stop her. Why ask if you don't need permission.

I did say this but she’s just worried about possible fallout. She has worked there for decades and all in all it’s a tidy number that fits in with her and our life together really well. We’ve all been there with crazy office politics and arse lickers that look for any excuse to give their supervisors gossip

I’ve said she really needs to go just in case things go teets up and she has something / anything to fall back on.

Any advice on how her tax would work?

She'll get charged 20% tax on her 2nd employment. After the end of the tax year HMRC should add both sets of earnings together and work out how much tax she should have paid. They'll then either a refund or ask her to pay more.

I’d say look at it this way - how much thought would the employer give your girlfriend if they need to let her go.

Also home shopping in Asda is seemingly growing at a great rate - my fiancée has worked for 15 years, if she takes that on it’ll be more secure and they are always looking for shifts to be covered.

No issue whatsoever unless it impacts on her "main" employer's business or is prohibited by her contract.

She cannot be disciplined for having a second job (unless, as above it affects the other employer's business). She has unfair dismissal rights.

Of course, there are always ways of engineering a dismissal (e.g. lying about a misconduct issue or declaring a redundancy scenario and fudging the scoring criteria etc) but that is always open to challenge by way of a Tribunal claim.

Personally, I would mention it to the main employer in the hope that it would prevent them from feeling aggrieved.

Most of ones I know working while furlough have already accounted for that, they only take cash.
