Why do I need a work visa?

If I apply for a role being advertised by an EU Company do I require a work visa if my work is 100% remote UK based?
Looking for the EU legal response.

If I compare my self with all those outsourcing relationships which must exist:

(1) Legal Company incorporated in the country (check)
(2) Registered employee of said company (check)
(3) No plans to go and work in Head Office country (check)

Only difference is that I am UK based rather than say India.

I would have thought that visa requirements relate to physically working IN a particular country - not working FOR a business that happens to have an overseas base.

It will vary jurisdiction to jurisdiction..

There are countries that will require a work visa or permit to be in place for you to work for a company that is registered in that country irrespective of where you are located..

Where are they advertising the role and which EU entity would you be contracted to? If not in the UK then you are an employee of an EU entity and as such would need a work permit to be employed by that entity.

Work Visas apply (mostly) when you work in a country and pay tax to that country's government. It's a means that enables that government to a) know that you're there, b) that you'll be working and earning and c) to expect a tax contribution from you.

Theoretically, you shouldn't need one. You'll get paid gross and make your own tax arrangements to HMRC in the UK.

I say theoretically because the legislation surrounding this differs from nation to nation and in respect of Brexit remains one of the myriad of issues that require sorting out - something that is ongoing. So something to be aware of is that the conditions that apply now may differ later on.

And keep in mind that the the UK government will incentivise you because you are brining money into the UK economy. The German government will take the opposing view so there will likely be additional deductions at source.

I get what you are saying but this looks like paid employment rather than consulting / freelance, unless I have read the OP wrong ?
