Discrimination.
Thankyou for any help

Would the following count as discrimination.

My job as a manager for a small team in the UK, taken to Amsterdam, the companies HQ. Companies explanation, higher management want to create singular management enabling closer collaboration by taking the role to Amsterdam.

My angle, discrimination due to location.

My old manager put’s me unfairly under a PIP, as I had complained about him years back, would this count as victimisation & injury to feeling under discrimination laws.

I’m finding it difficult to house the examples under the protected characteristics being.
Age, gender reassignment being married or in a civil partnership being pregnant or on maternity leave disability race including colour, nationality, ethnic or national origin religion or belief sexsexual orientation

I don't think you are, the place I work for recently made people redundant as they were localising teams.

What are the reasons for the PIP? Objective? Subjective? Missing KPIs? Behaviour? etc

You might have a better angle with constructive dismissal, particularly if the PIP that has been raised against you has no real merit.

Have you been offered to do the job in Amsterdam?

If your job is moving to Amsterdam, you should be offered to go with it.

Or are you being made redundant, in that the role is now ceased and is being incorporated into other roles in Amsterdam?

Discrimination has a very prescribed meaning in employment law. Feelings of unfairness and inequity are not necessarily discrimination.

The bar for Constructive Dismissal is pretty high, it'll be difficult to claim Constructive Dismissal in relation to the PIP when there's clear evidence that the OP wasn't forced to leave the company as a result. You really need to leave as soon as the Constructive Dismissal occurs, you can't just bank it for the future in case it comes in handy.

Can't answer for the legal aspect of it but is it worth the hassle? Time to brush up your CV?

Doesn't sound promising. I can envisage time and monies wasted on legal fees and possibly nuclear bombed bridges.

Seems like they're (possibly) trying to avoid correct redundancy by managing you out (PIP)

First 30 minute session is usually free with a solicitor. Spruce up the old CV, the jobs moving anyway.

Sounds like you’re trying to shoehorn your situation into a discrimination claim without any cause.
