They can't refuse to give you your P45. What reason are they giving?
This is from HMRC website on the employer's obligations when an employee leaves -
Completing a P45 for the employee
You must complete a P45 for any leaving employee for whom you are required to keep a form P11. Give parts 1A, 2 and 3 to the leaving employee and submit part 1 to HMRC.

He's breaking the law and you can report him to HMRC.In the meantime, to avoid being overtaxed in youir new employment, fill in a P46 for your new employer (as already suggested).
