Holiday entitlements

I may be off to pastures greener soon and I'm wondering what happens with the holiday entitlement at my current place of work? I get given 28 days at the start of April every year, to be used by the end of March the following year and I've currently got 8 days holiday left.
My question is should I use all my holiday before I start the new job, or as there will be 6 months of the work year left will they claim back a portion of my last paycheck? By that I mean I get 28 days for the year and will only have done 6 months of this year when I leave - are they entitled to claim 14 days back from me?
I hope that makes sense!
I've worked for my current company for 3 years if that makes a difference?

If your holiday is pro rata then yes, I think your employer would be able to claim back the cost of any used holiday days over and above what you have earned.

Generally you pro-rata your holiday entitlement and if the company owes you then they buy your holiday back off you at something pathetic like (salary / 365). If you're under then they may let you off or they may make a deduction from your final paycheque for it. Worth talking to your HR dept.

Ok cheers all.
No doubt they'll stiff me for it then, as one of the reasons I'm off is my current employers inability to pay overtime, shift allowance etc on time - if at all! That plus the huge payrise I'll be getting at the new place smile

If they do then at least take comfort that you'll make it back on the higher salary at the new place. It's just one of those things.

Check your contract, our policy is that if when you leave and you have taken too much holiday, the extra will be deducted from your final salary.
