quick question regarding vacancies (advertising of)

hi

had a look and did a search but no joy

so my question , is an employer under any legal obligation to advertise (internally or outside of the company) or make employee's aware of impending vacancies ?

My understanding is that even if you have internal vacancies and have someone lined up for the job it is employment law to advertise in order to be fair.

Normally vacancies are advertised internally first, in effect giving internal applicants a head start. However, it very much depends on the company and also the attitude of the management to whether or not they feel anyone could fulfill the requriements.

Not that I'm aware, however to avoid claims of discrimination many employers adopt this policy. The only time we don't is with high level or confidential vacancies, or those positions for which there is a clearly identified successor.

One blue chip I know has a "strong internal candidate" yes or no listed as a heading on the website job ads- yes obviously meaning apply but 99.9% chance you will get an interview and then a no!

Which is why when we have an already identified "shoe-in" via succession we're honest with people. Never had any issues with this approach which avoids false hopes and subsequent disappointment.
