Hello all,

This isn't my issue but my wife's.

It is likely that she will be made redundant this month and she has been told that the standard package will be 1 weeks pay for every year she's been there.

In total she has been there for just over 10 years, but part time for the last 2 years.

I am wondering if the redundancy will reflect this?

Do they *have* to do this or is it up to them?

It depends whether the enhanced redundancy is contractual.

If they wanted to be really a*al and fair then they could provide a payment based on 8 weeks full pay for those full time years and 2 weeks part time.

I suspect that when the estimate comes through it will reflect 10 weeks of part time salary.

Hi,

This is what i'm thinking - she will get a payment based on her current salary.

And yes, she is under 41, is this important?

The age is only relevant for statutory redundancy payment purposes although you will typically find that company enhancements will be based along similar age bands.

This really depends on what you or the company mean by a week's pay. For statutory payments a week's pay is up to a max of £380 even if you earn £10k a week. You may find the company will pay the difference between £380 and an actual week's pay or that the company will pay statutory plus a week's pay (or any other variations).

I see. Very interesting. I reckon she'll do OK with the years she has under her belt, but don't want to see her losing out on any more.
