The council I work for is going through a major restructure. We have seen a proposed new structure although won’t be told whether our jobs will slot in or not until Friday.

From the limited information that has been given out I can see my role fitting into two possible jobs. One is a role at the same grade which I’m currently on, so there’s a possibility that I could slot into this. However, I could also be ear-marked for a job that is on a grade lower.

I know that to “slot in” the new job has to be substantially the same as your current job, but I don’t know how this fits in with salary – can you be slotted automatically in to a lower paid role, or does it have to be the same grade?

I have emailed our HR department but they have lived up to their reputation and two weeks later I still haven’t had a response, although I know they have read the email.

Any help welcomed as I just want to know what my rights are should things not go my way.

To be honest, in the current climate, just having a job is a pretty good "right"!

In major restructuring exercises I have carried out, where a new role includes at least 60% of an existing role, the roles are aligned. It's the role which then carries a grade, but that doesn't mean that the incumbent has that grade.

So if you are aligned with a grade six role, when you are a grade five (grade one being the highest), you should retain your grade five status, though your pay will never exceed the band assigned to that grade six job (almost always a fair overlap anyway). If it is already above that grade's band, it will essentially be frozen.

However, shold you leave that role at any time - whether leaving the organisation or moving jobs within that employer - the role will be advertised at its proper grade and pay structure.

Oh, I quite agree! But I still want to know what they can and can't do!

V8mate - thanks. Some restructing has already taken place and for people whose roles did not slot in to the new structure they then had to apply and be interviewed for roles that were on a higher grade. I'm more concerned with slotting in on a lower grade. It may be that if I don't get a job on the same grade I will then have the 'opportunity' to apply for the job at the lower grade.

Yes, you can't be aligned with a job at a higher grade than your current one during a restructuring, so an application process always takes place. It's rare for 60%+ of a role to be transferred up the food chain anyway.
