e39 M5 to be written off by TP - must I accept?
Discussion
Pretty much as per the title. I was hit by an OAP who was pulling off her drive, driving forwards I might add :dont know: . The car is not the Porsche but my old e39 M5 with only 90,000 miles on the clock and all the toys aside from a USB connector. I am waiting for the email but do I need to accept this from third party insurers???????
These are up for sale for between £6,000 to £14,000 and I do not know what the estimate is as yet. Someone told me that you do not have to accept write off and can demand a repair. I may have made a mistake going to BMW but I am expecting a pathetic offer from the insurance company who incidentally have accepted blame.
It was a low impact shunt (inch depression/scrape) which damaged the front door, rear door and rear arch/wheel.
She is getting on a bit but is a lovely car to drive.
Anyone have any experience/advice on this matter. I know I can buy the salvage.
Pip

Definitely a write off... My E46 M3 was declared CAT D by Admiral for the following:These are up for sale for between £6,000 to £14,000 and I do not know what the estimate is as yet. Broken kidney grills, bent bonnet, broken headlight, broken foglight, scraped and scratched bumper, cracked kevlar bumper support and broken plastic cowling behind kidney grill. I was the 2nd owner from new, SMG with pretty much all the options ticked inlcuding NAV, FBMWSH, 80k miles at that point.
I accepted the write off, took the £10k settlement figure from Admiral, paid them £1.8k for the salvage, then spent another £2k to fix it and it is still in the family
Think will keep it forever... As I understand it, you don't have to accept what either insurance company tell you - it's your car, up to the point ownership transfers. If you want to keep & repair, why not, if the damage is either simple to repair, or not significant, you can witthdraw your claim. You may be able to negotiate a lower settlement & get the repairs done in your own time & cost - write off is assessed at dealer repair rates or worse. So, it depends on what the damage is, & what you're prepared to accept or haggle to get. Well worth a good surf to get the full sp.
Had exactly the same scenario over a year ago and haggled with the loss adjuster to agree to repair it. If you can make a good enough case dependant upon the good nature of the loss adjuster then sometimes they will ok the repair instead of a write off. (In my case the repair came to probably 80% of the cars actual value)
Well write off value put at a measely £6500 but I do not feel they have considered the upgrades dvd widescreen satnav, fully integrated BMW Bluetooth, Angel Eye Xenons, BMW Harmon Kardon sound system, the full BMW service history, refurbished wheels et cetera, et cetera.
I have sent the claims handlers (a third party through BMW) an email to get them to revise the value. I am really pi$$ed off about it all as she was a keeper and am now trying to comfort myself by looking at Mini JCW/GP as an alternative. I do not do many miles in her as I keep her for long journies only and cycle the rest of the time.
I was already looking at resprays post repair to bring her back up to full and faultless specification.
My wife has tried to console me and said perhaps it is for the best as she was getting old and I was always spending large amounts on her (the car AND my wife) due mainly to going through the dealers for servicing and repair.

Hi,
this happened to me with my E36 M3 a long time ago
Get as many examples of similar cars from AT, PH and the like as you can and use that as ammo.
If they take the P on the value (as they already are) give them a chance but then threaten legal action if they don't come up with a far value - they will try and swing the lead on it as obviously if they save just £500 on each write of, its champagne time for the shareholders

I have just bought my TVR back from an insurer after it was written off - they charge 25% of the payout value for you to buy it back. In other words if you can get it repaired for less than 75% of the payout you'll be quids in - albeit with a Cat D car - but not too relevant if it is a long term keeper. If you do keep and repair, make sure you get photos pre repair to show future buyers that it wasn't badly damaged.
