Following issues at this thread:

BMW now discussing giving me a replacement vehicle- anybody have any experience on how this works in practice?

I dont want to spam with too multiple threads, but wanted to get attention of people who might not have interest in prior thread, but have been offered a replacement vehicle- so apologies.

I have a a 40k 55 plates E63 and just wonder what BMW oculd offer in return (as i doubt they have similar cars to mine still in their stock due to age/mileage)...

Perhaps post on prior thread quoted above to keep it continous..not sure what the rules are on this!

Sorry, I've just seen this....I replied in your other thread.

BMW will be able to source an M6 to suit I'm sure, it would then be your decision.

I'm also quite sure that a non-M6 replacement could be negotiated, should you be thinking along those lines.

From personal experience, BMW(UK) will advise its between you & the dealer.

Has the dealer given you a value on your car yet? I'll wager it wont be what you paid for it, more like current PX value. .

No have not gone into details yet....dealer still discussing with BMW, not been resolved yet conclusively.

I suspect will depend on outcome of the new control unit that is hopefully arriving tomorrow and if that doesn't fix it, perhaps they will progress the discussions.

But yes given the scenario is that they have not solved a problem I don't think they should be short changing me re the value of the replacement...but I guess we will have to see!

I agree you should be given a new car if it's been in for so long but it doesn't fill me with confidence if they cannot diagnose it.

I'm in the middle of a buy back of my 62 plate X5 at the mo. It has a really bad paint defect on one side of it - looks like someone threw dust over it before they lacquered it in. Its on the bottoms of the doors so I didn't notice it til I'd given it its first wash! They have been really good. THey asked me if I would accept a respray, to which I explained politely and firmly "NO WAY!". So they're now buying it back and have ordered a new one. I have 4 BMW's in the household and we change them VERY regularly so they know us down there, but I'd like to think that they give same service to everyone. Dealer (Vines) was amazing too! Can't rate the Dealer Principal highly enough.

Not sure how it would work with a second hand car though! I'd imagine that yes it would be between you and the dealer.

Generally there is no real issues with a "rejection" of a used car.

If it has a recurring fault that cannot be repaired then under the sale of goods act you will be entitled to rewind the deal and have a refund of the purchase price. BMW GB should have nothing to do with it as your contract is with the supplying dealer so it is 100% their decision.

Check out the sale of goods act.

However if you have had the car for a while they may not be liable, if it is a short period of time you can argue that the fault was present at time of sale there for you are entitled to your money back!!! It gets messy if there is finance on it as there is an issue with payments and interest, however if you have got HP on the car, speak to the finance company and they will also put pressure on the supplying dealer, as officially they are the "owner" of the vehicle!!

New cars are a different story as you can simply have a new identical vehicle ordered!

Not so easy on used tho

If it helps......I bought a brand new 740d sport...it broke down after just 300 miles and was returned to the dealer....through BMW assist, they passed me on to Enterprise car rental, who duly supplied me with a 520d sport....so not quite like for like...

In the end the car took 4 weeks to fix due to parts availability

During those 4 weeks I tied to get a decent courtesy vehicle but the bext they got me was a 530d sport....

I was hoping they'd sort me an M5 or something out for my troubles, but alas that was merely wishful thinking!!
