It is a 2006 model, so hadn't had the security update - when I last tried that route, BMW were not very receptive to the idea there was any issue to resolve. Obviously I shall be following up on that one more forcefully!

I am so glad to hear that the police found the car back!!

Yes, if I were you I'd follow up with BMW strongly, I haven't done mine yet but I heard others getting it done for free of charge with no questions asked from BMW.
Really glad you'll have the car back soon mate, perhaps some other security upgrades such as immobiliser or similar sort might be worth considering

if they didn't recover the keys you may have a problem with them coming back . they may have just left it parked up .to see if it had a tracker. and the police had a lucky spot .

OP does yours have mechanical key or stop start ?

Can they steal E46 M3s with this method ?

OP: maybe better to delete the VIN from the title, now that the car is found?
