M3 run in service late

I bought my M3 cab with 2600 miles on it in march 2007 it was reg dec 05
I purchased it from a very large BMW specialist in Essex (Big Motor World).
I trusted that every thing was in order with the car and bought it without checking that the 1200 mile service was done on time. not so lucky it was being done the day of collection (2600 miles)
15 months old.
the car is now on 15700 miles and runs perfectly, in fact its better than my previous 54 reg m3 that was serviced on time in as much as I dont get the pinking with this one but I did from the other even though I always use super grade unleaded on both cars.
can anyone tell me if this is a big downfall when I come to sell it and would the warantee be void?
I have made complaints to the supplying dealer but cant get anywhere with them, they dont even return your call!!! any one thinking of buying from them should do their homework first or keep away cos all they want to do is take your money. It would be good to here from anyone else with the same problem.

Regarding your car.
Warranty on the engine will be void, but then it is now out of warranty anyway surely??
Yes it will be harder to move on, how much harder depends on how much you want to drop the price.
To put this in perspective I was offered a 2006 coupe from BMW Norwich back in 2007 for £22k, this was back when this car was booking for £32k trade and £35k retail all because it had missed the run in service and wasn't done till 2100 miles. They had missed it when taking it in.
However, as these cars get older then it is mattering less I guess, but you still haven't got a full BMW history, first service is not only late but also not done by BMW, that would be more of a concern to me. Did you get the oil service done at BMW, what about the Inspection I due in December, where will that be done??

You do realise that just about every warranty company have in their small print ".......all cars must have been serviced on time and within manufacturers guidelines."
If you have not done this they will wriggle out of any claim, so be careful if you are paying for something that you can't use.
Thanks for your views, I forgot to mention the 1st service was caried out at an approved dealer (cooper bmw) You would think that they would have an obligation to inform the would be purchaser that all warranty's are void ? especialy as it seems to be quite critical, instead the service was done and book stamped up with relevant paperwork in the normal way.
The next service was done at 9998 miles in may 2008 by my local main dealer who has also caried out warranty work on 3 seperate occasions with no probs>>
Any body think I may have a case against the supplying dealer as it was sold to me with full main dealer history and manufacturers warranty till dec 08 of which I have a copy of the original add and at no point was I told its 1st service was outside warranty guidlines? not that it matters to me now but if this car ended up at another dealer then it wouldnt be able to have a new warranty and im left with a car I cant move on unless I give it away.

We've just come to the end of a PCP on a 2006 330cd. BMW attach a list of charges that will applied for damage such a dents, scuffed alloys etc. Listed within this Tariff is the penalty for missing the running in service on a M3- £4000. Given most PCP cars are at least 3 years old (and therefore likely to be auctioned rather go back to a main dealer this suggests £4k is penalty the trade would apply. As others have said the older the car get the lower this should be. Bear in mind that you can't extend the BMW warranty if the 1st servive had been missed

I don't know, it depends on how you hit them with it, if you took them to court (which I guess you would have to) then you could go with the fact 'you didn't know they lied about the warranty and history until you tried to use it.'
However, you have passed 2008 so a bit late now??
I would take it as a learning experience, you will get shafted come resale, unless you shaft someone else, and do your homework better next time.
Just enjoy the car now. It's still a fantastic car.

just take them to small claims court, it's only £90 isn't it? With no lawyer fees or anything. I'm sure a friendly car dealer will furnish you with a letter saying it is worth say £3k less and sue them for that amount.

For the sake of under £100, what have you got to loose? I've used the small claims court for a similar amount in the past (not car related) and its a very quick and simple process.
I would think you do not have much of a case as one can say it was your responsibility to check the paperwork was all in order.
Even if they said the running in was done at 1200 they can always say they never said such a thing, so its your word against theirs.
Its very unfortunate when one deals with these type of dealers as once the car leaves their premises they do not want to know.

The running in service has a +-500 miles grace of the 1200 mile running in service and as pointed out BMW would have washed their hands in the event of an engine related warranty claim
