BMW E46 M3 Rear Springs (Again!)

My first post on this seems to have disappeared!? Try again...
My car is a 53 plate E46 M3 bought as an Approved Used Car (AUC) 2.5 yrs ago. In Oct 08 both rear springs went and were duly replaced under the warranty.
Roll on this morning (and approx 30000 miles) and the rear springs have gone again! BMW dealership claims that parts installed under BMW AUC warranty do not get the same 2 year parts warranty as you would normally get. They are only guaranteed if the AUC warranty is still in force, which mine is not. They are investigating a goodwill gesture payment but this could take several days to get a reply about.
So, is it acceptable for the springs to go again after such a short period and has any one had any joy getting a goodwill gesture out of BMW? If it is not going to happen I will just get my local indie to sort it out as I need the car ASAP for work duties.

To clarify - I am being told that normally BMW parts have a 2 year warranty. The exception to this being that if a part is replaced under the AUC Warranty as mine were they are only covered as long as the AUC warranty last. Therefore effectively my springs only had a warranty for the four or so remaining months on the cars BMW warranty!
I have not yet had a price from the BMW dealer; I am waiting to hear if they will put any money towards it.
I have been quoted £78 each for a genuine parts and a total fitted price of about £200 from my excellent local independent.

I believe this is true for the "new car" warranty.Is the AUC "warranty" an insurance product ? eg. BMW Insured Warranty or similar?

This being the case tell them to stick the BMW waffle and rely on the Sales of Goods Act - the parts must have been faulty at the time of fitting if they went after this time/mileageI have not yet had a price from the BMW dealer; I am waiting to hear if they will put any money towards it.

Tell them if you dont get a refund/refit FOC you're going to trading standards
