I visited a Rolex dealer yesterday to enquire about a ceramic steel Daytona. They said if they sold me one they'd keep the guarantee for 12 months to stop me selling it straightaway. Is this legal?

Probably not, but then what can you actually do about it? As you won’t get near the top of the ‘list’ without agreeing to it.

Kind of fail to see the issue if you’re intending to keep it anyway.

I’d buy it from somewhere else.

I think it’s extraordinary that dealers try to dictate what you do with a watch you’ve paid thousands for. They can only do it because buyers go along with this madness.

I’ve done exactly this myself. No way I’d buy from a dealership that was going to keep my watch’s paperwork.

This isn’t normal.

Circumstances change, not everyone that sells relatively quickly is doing it for the obvious reason, some sell because they NEED the £9.5k they spent regardless of any extra £

Not just that but I’ve heard of lots of people who finally get one and realise it’s not really “them”, I’m sure this happens because of the hype, MUST have that MUST HAVE watch without actually loving the thing, once they’ve got it and spent time with it, the polished centre links and relatively small looking dial start putting doubts in people’s minds!

I was outside a 2nd hand dealer the other day and heard 2 guys point out the Daytona, one of them said “I always think I want one until I try them on”

Because most ADs don’t sell used watches (if any do) they can’t buy it back at retail to stop the selling on to dealers and creatoing what we have now!

I just wouldn’t buy without the warranty card, I love peeling the stickers off but that’s no big deal!

I’m picking up a GMT BLNR from a UK AD at the end of this week.

I have no issue with them filling out the warranty card with my details and retaining it for a year.

The reason is simple - I have no intention of flipping the watch. It will join my (small) collection and will be worn on rotation.

Me too. I'd tell the dealer why as well, otherwise they'll think it's acceptable and you were just a 'time-waster'. Once you buy something it's yours to do whatever the fk you want with it, not have a dealer tell you you're not allowed to sell it on if you want or need to!

It's pretty much Rolex policy now to all AD's, and not just UK, same instructions have gone to many EU and USA AD's as well in the last 12 months.

The big chain UK AD's have all the same policy, so if you want the watch, then you'll have to accept it. As said, its not a problem if you are keeping the watch, its only a problem if you are buying it to flip for a quick buck, which is the whole reason behind this Rolex policy.

You may find a few independent UK AD's that don't operate this policy, but you will be starting from scratch building a relationship or getting on a list again, and Rolex does seem to be gradually trying to eliminate the independent AD's from the list. Rumour is another 6 of them have just been informed of loosing AD's status in the past month or so.

I bought one from Mappin and Webb in bluewater a few months ago they certainly didn’t want to keep the paperwork.

Whereas some trumped up bloke in a small watch shop Horsham said they would as if I was lucky to be getting a Rolex from him.

It’s all gone wrong somewhere if people think this is normal and are going along with it.

I’ve asked in loads of large Rolex dealerships in the states and all over the Caribbean and none of them did this either.

I've had a no date sub and a GMT BLNR from the same dealer this year. He hung on to the paperwork for the Batman but not the Sub. Not a problem with me as they are going to be kept for the long haul anyway. I did get a colour photocopy of the Batman papers and I imagine flippers still advertise watches with photocopies of the paperwork or an IOU for when they are returned so I'm not sure it solves the issue.

Interesting, I bought from M+W (Aurum group) in July this year and they’ve kept the paperwork for 12 months.

Selling mine as soon as I get the paperwork, i really don’t like the pcl, it’s too flashy and I feel uncomfortable wearing something that expensive, will be spent on a car instead smile

Agreed, it's your watch once bought.

Going along with this unreasonable behaviour just encourages the madness, I'd tell them to shove it and go elsewhere.

Be interesting to see what would happen if someone agrees to leave the papers with the AD, purchases the watch and then demands the papers. As stated early in this thread, I cannot see the AD having a legal leg to stand on.
If it ever got to court, I cannot see the AD or Rolex winning and that would just open the flood gates for everyone else.

Only takes one

Do any other watch brands have this policy? Flipping a new Nautilus or Aquanaut would be very profitable for example... not sure if Patek have the same policy.

But don't expect to be able to buy another highly sought after watch from them.

It's a seller's market.

I live in the US, all of my Local ADs do this and have done for a while.
