Help me settle a discussion, I reckon a Twix is a chocolate bar the Mrs is adamant it's a biscuit! rolleyes

IIRC the distinction is that anything with chocolate on is VATable. So digestives are VAT free and in the eyes of the treasury true biscuits, but the choccy ones aren't.

Chocolate isn't the defining thing, it's whether it's a luxury item or not - eg chocie biscuit would be taxed, chocolate cake wouldn't be.

OK her argument is that a caramel rocky is undoubtedly a biscuit but has caramel and chocolate, it's made of the same stuff as a twix so they both must categorised as the same.

It's on the shelves with mars bars, snickers and wispas. Therefore it's a chocolate bar.

Boring answer - it depends on local tax classifications, so either - or neither - depending on where you rest your hat.
UK tax definitions are pretty clear cut for it, US ones a little different. In the UK it's simply labelled as a confectionary VAT wise, which is standard rate. In the US, for the purposes of sales tax, you've got what's known as the Twix Tax Test - no really! - which basically states that if it's got flour in or it needs to be kept refrigerated at the sales outlet, it's not a candy bar. It's sort of like the US' own version of the great Jaffa Cake vs HMRC legal battle.

FWIW I list them in the Chocolate bar category in my business' database, price lists etc.

For me, to be a biscuit there should be several in a single packet. Two doesn't count.
