Mr Charles said: "A minor criminal offence I committed as a 14-year-old... for which I was given a year's conditional discharge has now barred me from standing for the PCC post.

"I have today taken the difficult decision to stand down as the Labour Party candidate for Police and Crime Commissioner for Derbyshire."

Mr Ashford said that in 1966, aged 13, he was convicted of trespassing and being in possession of an offensive weapon.

He was fined £2, 10 shillings for both offences.

Last month doubts were raised over whether Mr Weston could run because as a 14-year-old he was convicted - and fined - for being a passenger in a stolen car.

But Home Secretary Theresa May said the legislation was not aimed at barring someone who had a conviction at the age of 16.
It seems to be doing the job

No exception should be made - what should have happened is that parliament should have drafted this rule properly, to make it tally up with the Rehabilitation of Offenders Act in some way. Instead of that they've managed to cook up another category of ex-offender. Bravo.

I thought the slate was wiped clean at 17 or have I watch too many US cop shows.

Sloppy legislation, they could stand as an MP or actually join the force but not help run it. One of the guys has been deputy on the local police board for the last 20 years FFS, sound like an ideas candidate.

given that "The Police Reform and Social Responsibility Act 2011 disqualifies a person from standing for election as a PCC if they have at any time been convicted of an offence for which a person could be sent to prison; whether or not they themselves were sent to prison for that offence."

that would be the same category of 'ex offender' as anyone who is 'security cleared', or works with children or vulnerable adults or in healthcare .... i.e. roles which are exempt from the provisions that make convictions 'spent' in the Rehabilitation of Offenders Act. where even relatively minor convictions at an early age can effectively bar you from posts ...

Maybe not a lot of people know that
You're told at a young age that you must own up and everything will be ok
Best change the teaching to neither confirm nor deny
and if it is you, dont get caught!

You would think, wouldn't you? However the rules surrounding the exempt roles are different again, and will bring up any recordable offence, whether it was imprisonable or not.

Those offences which are covered by the exempt roles list, but not by the police commissioner list, include

offences related to prostitution;
malicious communication; 'improper use' of the public telecommunications system;
tampering with a motor vehicle;
certain offences relating to inadequate care of children;
certain offences relating to shotguns and airguns;
certain offences relating to poaching for game;
offences relating to public drunkenness;
certain offences relating to management of licensed premises;
falsely claiming a professional qualification;
impersonating a police constable;
certain public order offences, e.g., failing to give notice of a procession;
allowing alchohol to be supplied at sporting events where it is prohibited;
having a bladed weapon or crossbow in public.

According to

http://www.lawiki.org/lawwiki/Recordable_offence

So if the maximum sentence for any of the above didn't include imprisonment, then they wouldn't bar someone from being a police commissioner.

I suspect that the bookies would offer very short odds on that.
