Anybody else think that the mitigation line put forward by Hall's barrister Crispin Aylett that the former broadcaster had "all of 13" victims compared to Jimmy Savile's 1,300 was perhaps not the best defence?

Let's hope he soon experiences what it's like to sexually violated at his new home.

Only 13 times though, cause that's alright.

One where they're duty bound to act in their clients' best interests, and to remind the court that it's Stuart Hall being sentenced, not Stuart Hall and the legacy of Saville.

If the best mitigation you can offer is "my client's a nasty piece of work, sure, just not as much of a total bd as Jimmy Savile" then perhaps silence would have been a better option.

Of course I understand their duty of care but comparing a client to another wrongdoer in the hope of getting a lower tariff is surely the action of a madman? Maybe I'm the mad one. I just don't know any more.

Maybe the defenses line of thinking is that JS committed 1300 offences and never went to prison. So because Stuart Hall only committed 13 offences he also shouldn't go to prison.

And look... A WOOKIE !!

It's a fine line. But they will point out they are not trying for a lower sentence ( in reality they are because its good for business ) , but in this case he should not get a higher sentence than normal for being associated with Jimmy/ BBC scandal, it being judged free from any desiree to been seen to be making amends because he is/was a celeb, rather than if a nobody was up on the exact same charge.

At 83, 15 months could be a life sentence.

Unless he's very quickly moved to an 'open' style prison, I imagine you are right.

I understand he transferred ownership of his house to his wife in Feb this year (before he pleaded guilty), on health grounds. Compo lawyers are allegedly trying to get that transfer nullified. I expect Brenda might want her OBE back too.

The Law Pages:

Likely release date - 17/01/2014

So six months then.

Mitigation:

Good character
Early Plea
Remorse
Character References/Witnesses. [/i]

The early plea was somewhat discredited due to him initally denying the allegations in a public statement.

And you trust those figures? Release 2012?

Out on a tag in 4 months, 4 months on that. Much as Huhne, I suspect.

Very friendly, hands all over you, had the medical room, ladies washroom next door and many visiting for presumably more than coffee for the night.
It was a different world 45 years ago
Wasnt it?
Not for indecently assaulting a 9 yrs old it wasn't.

In some ways he's lucky. If that had got out at the time [yes, another thread] he'd have been lucky to get away with the kicking of his life.

File with Bridger's "at least I only murdered one child" gambit in the annals of weak mitigation.
