Assuming his death is a direct result of the attack of course.

I have know idea, most certainly not intentional.

There used to be a stipulation that if the victim lived a year and a day after the attack, it wasn't murder.

I think that was removed a few years ago.

Here is a similar case from 2011 where they did go back and charge someone, who was previously convicted of gbh and jailed for it, with murder.

Assuming it's the same as over here (there may be differences), the is no time limit for a murder prosecution. A 'year and a day' was abolished in 1996. If it's more than 3 years between the event and the death, then there's needs to be permission from the Attorney General to prosecute. The same permission is needed if the offenders have been convicted of a lesser offence.

Wow... I always thought that once you were charged for a crime, then it was over and done with, think they called it double jeopardy at the time.


Edit to say that I notice this has been abolished in 2005 and you can now be tried multiple times.

That's the same crime with the same evidence isn't it? This would be a different crime with new err evidence.

Yup, changed in 1996 under the Law Reform (Year and a Day Rule) Act 1996 due to people being able to live a lot longer now with the assistance of life support.

The CPS are going to review the Boparan crash case.
